Terms and Conditions of Gift Cards

These terms and conditions (“Terms and Conditions”) govern the purchase, sale, and use of gift cards and gift certificates (“Gift Cards”) issued by The Sill, Inc.(“The Sill,” “we,” “us,” or “our”). Gift Cards must be redeemed through our website at https://www.thesill.com/ (“Website”) or at any of our bricks-and-mortar stores in the U.S.Purchases made using Gift Cards are subject to our Website Terms of Use (https://www.thesill.com/pages/terms-conditions) in addition to these Terms and Conditions, and such Website Terms of Use are incorporated herein and made a part of these Terms and Conditions by reference.The Sill reserves the right to update and/or change these Terms and Conditions at any time without notice.Use of a Gift Card constitutes your acceptance of these Terms and Conditions.

The funds on Gift Cards issued by The Sill does not expire, and dormancy fees do not apply. If the physical Gift Card expires or is otherwise unusable, but a balance still remains on the Gift Card, you may contact The Sill at info@thesill.com for a replacement card. 

Information regarding the balance of your Gift Card is available by calling (646) 899-4015. You may also inquire regarding your balance at any of our stores. The balance you receive when inquiring is an estimate only.In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed.

Gift Cards are not redeemable for cash and cannot be returned for a cash refund, unless required by law.Except as otherwise provided, any unused balance will remain on the Gift Card and is non-transferable.Gift Cards are not reloadable, and are not for resale.Gift Cards may not be used to purchase other Gift Cards.

The Sill permits returns and exchanges of merchandise purchased using a Gift Card for up to thirty (30) days following the purchase date.All returns for purchases made using a Gift Card will result in credit to the Gift Card or issuance of a new Gift Card in the amount of the return.Email us at info@thesill.com to process a return or exchange. Note that depending on the day, it may take up to forty eight (48) hours to receive a response. 

The Sill is not responsible for lost, stolen, damaged, or destroyed Gift Cards, or use of a Gift Card without your permission, and The Sill will not issue a replacement Gift Card in these circumstances.The Sill reserves the right to correct a Gift Card balance if we believe that a clerical, billing, or accounting error has occurred.We further reserve the right to deactivate, cancel, or suspend any Gift Card if we suspect fraud, unlawful activity, or improper Gift Card use.

The maximum value that can be associated with any one Gift Card is five hundred dollars ($500.00) and total purchases of Gift Cards by any one individual may not exceed two thousand dollars ($2,000.00) in one calendar day.

All personal data collected during the sale and use of Gift Cards will be treated in accordance with our Privacy Policy found at https://www.thesill.com/pages/privacy-policy.

THE SILL AND OUR AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ITS GIFT CARDS, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

Please note that promotional cards or gifts offered by The Sill, including, without limitation, promotional gift cards offered in connection with loyalty rewards programs or employee rewards programs, may be subject to an expiration date and separate terms and conditions.

If any provision of these Terms and Conditions is determined to be invalid, illegal or unenforceable, the remaining provisions of these Terms and Conditions remain in full force to the extent permitted by law.These Terms and Conditions are governed by the laws of the State of New York.
